A Tennessee judge has granted a temporary injunction on a new law that would ban the sale of hemp products containing THCa. Under the new law, which was set to go into effect on December 26th, the Tennessee Department of Agriculture will decide what products hemp stores can sell.
Advocates for the hemp industry filed the lawsuit against the Tennessee Department of Agriculture in early December 2024 and the judge put a pause on the new rules on December 23rd.
THCa is a naturally, nonintoxicating acid in all hemp plants, which is legal in Tennessee. However, when THCa is heated or smoked, it converts to THC, which is an active ingredient in marijuana, and is illegal in Tennessee.
The Plaintiffs must now file additional briefing and affidavits with the Court no later than January 22, 2025.
The Defendant must also file additional briefing and affidavits no later than February 5, 2025.
The final hearing is set for February 18, 2025.
The Tennessee Growers Coalition says it is fighting for a permanent injunction on the new Tennessee Department of Agriculture rules.
