The Tennessee Supreme Court has overturned a lower court’s temporary injunction for death row inmate Byron Lewis Black, who sought to have his implanted defibrillation device deactivated shortly before he is set to die by lethal injection on Tuesday, August 5 (2025). Black argued that the effects of pentobarbital will trigger the device to shock his heart, resulting in the infliction of extreme pain in violation of the Eighth Amendment. He was convicted in the 1988 shooting deaths of his 29-year-old girlfriend and her two daughters, ages 6 and 9.
